1. Acceptance of Terms and Eligibility

Welcome to Coastal BathCo. These Terms of Service ("Terms") constitute a legally binding agreement between you and Coastal BathCo ("we," "us," "our," or "Coastal BathCo") governing your access to and use of our online store located at coastalbathco.myshopify.com (the "Site"), including all related information, content, features, tools, products, and services we provide (collectively, the "Services"). Coastal BathCo operates this store and website powered by Shopify to provide you with a curated shopping experience.

By visiting, browsing, or using the Services, or by placing an order with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you must not access or use the Services.

You represent and warrant that you are at least the age of majority in your state or province of residence (at least 18 years of age in most US jurisdictions), and that you possess the legal authority to enter into this binding agreement. If you are under the age of majority, you may use the Services only with the involvement and consent of a parent or legal guardian. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion, including if we believe that customer conduct violates applicable law or is harmful to our interests.

2. The Store and Products

Coastal BathCo offers bath and home products for sale through the Site. We have made every effort to display our products and their colors, features, specifications, and details as accurately as possible. However, we do not warrant that product descriptions, colors, information, or other content available on the Site are accurate, complete, reliable, current, or error-free. The appearance of products may vary depending on your monitor, device settings, and configuration. We do not warrant that the appearance, quality, or performance of any products purchased will meet your expectations or be identical to images or descriptions displayed on the Site.

All product descriptions, images, references, features, content, specifications, products, and prices are subject to change at any time without prior notice at our sole discretion. We reserve the right to discontinue any product at any time for any reason. We also reserve the right to limit the quantities of any products or services that we offer, on a per-person, per-household, per-order, or per-geographic-region basis, and to refuse or cancel any order for any reason in our sole discretion.

The inclusion of any products or services on the Site at a particular time does not imply or warrant that these products or services will be available at any other time. You acknowledge that products are subject to availability and that we may experience shortages or delays in supply.

You represent and warrant that any purchases you make through the Site are for your own personal, family, or household use and not for commercial resale, export, or distribution.

3. Orders and Order Acceptance

When you place an order through the Site, you are making an offer to purchase the products specified in your order. All orders are subject to acceptance by Coastal BathCo. We reserve the right, in our sole discretion, to accept or decline any order for any reason, including but not limited to product availability, errors in product or pricing information, fraud concerns, or problems identified by our credit or fraud avoidance department.

Your order is not accepted, and no contract of sale is formed, until we send you an order confirmation email confirming acceptance of your order. We must receive and process your payment before your order is accepted. The order confirmation email will include your order details and confirmation number. If your order is not accepted, we will not charge your payment method.

Please review your order carefully before submitting it. Once an order has been accepted and confirmed, Coastal BathCo may be unable to accommodate cancellation or modification requests, though we will make reasonable efforts to assist you if you contact us promptly at contact@coastalbathco.shop or +61485906999.

In the event that we do not accept an order, make a change to an order, or cancel an order after acceptance due to product unavailability, pricing error, or other issue, we will attempt to notify you using the email address, billing address, and/or phone number you provided at the time the order was placed. If we cancel an order after charging your payment method, we will issue a refund to the original payment method.

We reserve the right to limit order quantities and to reject orders that appear to be placed by dealers, resellers, or distributors, or orders that we believe in good faith to be fraudulent or in violation of these Terms.

4. Pricing and Sales Tax

All prices displayed on the Site are in Australian Dollars (AUD) and are exclusive of applicable taxes unless expressly stated otherwise. Prices are subject to change at any time without prior notice. The price charged for a product will be the price in effect at the time your order is placed and confirmed, as set out in your order confirmation email.

Applicable sales tax will be calculated and added to your order total at checkout based on the applicable tax rates for your shipping destination. The total amount you will be charged, including all applicable taxes, will be displayed before you complete your purchase. You are responsible for payment of all applicable federal, state, and local sales, use, and excise taxes.

Prices posted on the Site may differ from prices offered in any physical retail locations or through third-party sellers or platforms. Promotional pricing, discounts, coupon codes, and special offers are subject to specific terms and conditions and may be modified or discontinued at any time. In the event of a conflict between these Terms and the terms governing a specific promotion, the promotion-specific terms shall control with respect to that promotion.

From time to time, there may be information on the Site that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice, including after you have submitted your order or received an order confirmation.

5. Payment

Payment for all purchases must be made at the time you place your order. We accept payment by major credit cards, debit cards, and other payment methods as indicated on the Site. All payments are processed securely through our third-party payment processor(s).

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made through the Site. You agree to promptly update your account and other information, including your email address, payment card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that: (a) you have the legal right to use any payment method you provide to us; (b) the payment information you supply is true, correct, and complete; (c) you are duly authorized to make purchases using the payment method provided; (d) charges incurred by you will be honored by your payment card issuer or financial institution; and (e) you will pay all charges incurred by you at the prices posted, including all applicable taxes.

By providing payment card information, you authorize us (and/or our third-party payment processor) to charge the payment method provided for the total amount of your purchase, including all applicable taxes. If we do not receive payment from your payment card issuer or its agent, you agree to pay all amounts due upon demand by us.

We reserve the right to refuse or cancel any order if fraud or an unauthorized or illegal transaction is suspected. We may also verify your payment information before accepting any order.

6. Shipping and Delivery

We ship products to addresses within Australia and the United States. Detailed information about our shipping policies, delivery times, and procedures is available on our Shipping Policy page, which is incorporated into these Terms by reference.

Shipping within Australia is FREE for all orders. There are no shipping costs for orders delivered to Australian addresses. For orders shipped to the United States, please refer to our Shipping Policy page for applicable shipping costs and options.

Estimated delivery time for orders is 3-5 working days from the date of order acceptance. This timeframe is an estimate only and begins after your order has been processed and dispatched. Delivery times may vary based on your location, shipping method selected, product availability, carrier processing, and other factors beyond our control.

Title and risk of loss for products purchased from Coastal BathCo pass to you upon delivery to the shipping carrier. We are not responsible or liable for any delays in shipping or delivery, including delays caused by shipping carriers, customs or quarantine processing, weather events, natural disasters, public health emergencies, labor disputes, or other events or circumstances beyond our reasonable control.

You are responsible for providing an accurate and complete shipping address. We are not responsible for orders delivered to incorrect or incomplete addresses provided by you. If a shipment is returned to us due to an incorrect address, refusal of delivery, or failure to retrieve the package, you may be responsible for original shipping costs and return shipping fees, and we reserve the right to charge a restocking fee.

7. Returns and Refunds

Coastal BathCo wants you to be satisfied with your purchase. If you are not completely satisfied with a product you have purchased, you may return it in accordance with our Return and Refund Policy. Please note that under US federal law and the laws of most US states, there is no automatic statutory "cooling-off period" or right of withdrawal for online purchases. Returns are accepted in accordance with our voluntary 30-day return policy as described in our Return and Refund Policy page.

Refunds, when approved, will be issued to the original payment method used for the purchase. Please allow a reasonable time for the refund to be processed by your financial institution after we have processed your return.

8. Intellectual Property Rights

The Site and Services, including all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, graphics, photographs, logos, trademarks, service marks, trade names, product designs, page headers, button icons, scripts, and the design, selection, and arrangement thereof), are owned by Coastal BathCo, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Site for your personal, non-commercial use only. The Coastal BathCo name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Coastal BathCo or its affiliates or licensors. You must not use such marks without the prior written permission of Coastal BathCo. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

9. Acceptable Use and Prohibited Conduct

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

  • In any way that violates any applicable federal, state, local, or international law or regulation;
  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way;

  • To use any manual process to monitor or copy any of the material on the Site or for any other unauthorized purpose without our prior written consent;

YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

NEITHER COASTAL BATHCO NOR ANY PERSON ASSOCIATED WITH COASTAL BATHCO MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY
